Can a 16 ga. stranded wire be used to connect the disposal direct to a switch?

I have 12 ga. solid wire from 20 amp breaker to switch. 20 amp requires 12 ga. by code. But power cord kit is only 16 ga. I realize it would plug into receptacle normally but I would like to wire it directly into my switch box. Will this violate code? I am mounting the switch on the front of the cabinet in front of the sink. I would prefer to connect the stranded wires instead of 12 ga. solid wires. It has been suggested that the disposal be plugged into a GFCI. Do you recommend that?
